1. Acceptance of Terms
By placing an order or using the MagnetizeUS website ("Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site. MagnetizeUS is operated from Elk River, Minnesota.
2. Products & Order Acceptance
All magnets are custom-produced 2.5×2.5" die-cut photo magnets. Your order is accepted and confirmed once payment is successfully processed through Stripe. We reserve the right to refuse or cancel any order at our discretion, including orders containing inappropriate, copyrighted without permission, or illegal content. If we cancel your order, you will receive a full refund.
3. Production & Shipping Timelines
- Pre-made magnet sets: Ship within 2–3 days.
- Custom orders (uploaded photos): Allow 2–3 days for production and manufacturing before shipping.
- Magnet of the Month subscriptions: Shipped monthly, typically within the first two weeks of each month.
Estimated timelines are not guaranteed. Delays due to carrier issues, holidays, or high order volume are outside our control. We will notify you of significant delays.
4. Refund & Reprint Policy
Because every order is custom-produced, we do not accept returns or exchanges for change of mind. However, we stand behind our quality:
- If your magnet arrives damaged or has a manufacturing defect, contact us within 14 days with a photo of the issue. We will reprint or refund at no charge.
- If your order is lost in transit, we will reprint and reship after confirming with the carrier.
- Refunds for approved claims are issued to the original payment method within 5–10 business days.
We are not responsible for errors in photos, text, or designs you provide. Please review your order carefully before submitting.
5. Subscription Terms ("Magnet of the Month Club")
- Subscriptions automatically renew monthly or annually depending on the plan you select.
- You may cancel your subscription at any time through your Stripe customer portal or by contacting us. Cancellations take effect at the end of the current billing period — no partial refunds for unused time.
- We reserve the right to change subscription pricing with 30 days' notice.
- Gift subscriptions are non-refundable after the first shipment has been sent.
6. Intellectual Property & Photo Rights
By uploading a photo, you confirm that you own the rights to that image or have permission to use it for this purpose. You grant MagnetizeUS a limited license to use your photo solely for producing your order. We will never use your photos in our marketing without your explicit written consent.
7. Prohibited Content
You may not submit images or designs that are obscene, defamatory, infringing on third-party intellectual property (logos, trademarks, celebrity likenesses without permission), or otherwise unlawful. We reserve the right to refuse such orders without refund.
8. Limitation of Liability
To the fullest extent permitted by law, MagnetizeUS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability to you shall not exceed the amount you paid for the specific order giving rise to the claim.
9. Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Minnesota.
10. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
